These Terms of Service ("Terms") govern your use of NDIS Ready ("the Platform"), a product of Sacred Systems Pty Ltd (ABN 23 690 792 655) ("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms.
1. About NDIS Ready
NDIS Ready is a compliance tool designed to assist NDIS providers with registration preparation, policy document generation, and ongoing compliance tracking. The Platform does not provide legal, financial, or registration advice. All content is provided for informational and operational purposes only.
2. Eligibility
You must be at least 18 years old and operating as, or on behalf of, an organisation seeking or holding NDIS registration to use the Platform. By using NDIS Ready, you confirm that you meet these requirements.
3. Accounts and Access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@ndis-ready.com.au if you believe your account has been compromised.
4. Plans and Payments
4.1 Free Plan
The free quiz and checklist are provided at no cost. No credit card is required.
4.2 Paid Plans
Paid plans (Registration Kit, Best Value Bundle, Stay Ready) are subject to the pricing shown on the Platform at the time of purchase. All prices are in Australian Dollars (AUD) and include GST where applicable.
4.3 One-Time Payments
One-time payments (e.g., Registration Kit at $249, Best Value Bundle at $499) purchase digital products. Because digital documents can be copied and retained, they are non-refundable once you have downloaded or otherwise accessed them, except where required by the Australian Consumer Law.
4.4 Subscriptions
Monthly and annual subscriptions (e.g., Stay Ready at $49/month) will renew automatically until cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused periods.
4.5 Refunds
We offer a 7-day pre-download refund on one-time purchases. If you have not yet downloaded your documents, contact us at hello@ndis-ready.com.au within 7 days of purchase for a full refund. Once your documents have been downloaded or accessed they are non-refundable, as they are digital products that can be copied and kept. Nothing in this clause limits any rights or remedies you may have under the Australian Consumer Law, including in respect of goods or services that are not of acceptable quality.
5. Intellectual Property
All content on the Platform, including policy templates, software, text, and design, is owned by Sacred Systems Pty Ltd or its licensors. You are granted a non-exclusive, non-transferable licence to use the documents generated for you for the internal compliance purposes of your organisation only. You may not resell, redistribute, or sublicense any content from the Platform.
6. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable regulations
- Share your account access with third parties
- Attempt to reverse-engineer, scrape, or copy the Platform's content or templates at scale
- Submit false or misleading information through the quiz or onboarding process
- Use the Platform to generate documents for an organisation other than your own without written consent from us
7. No Guarantee of Audit Outcome
NDIS Ready provides tools and templates to assist with compliance preparation. We do not guarantee that use of the Platform will result in a successful NDIS audit, certification, or registration outcome. Audit outcomes depend on many factors beyond the scope of this Platform. We strongly recommend engaging a registered NDIS consultant or legal adviser for complex situations.
8. Limitation of Liability
To the maximum extent permitted by law, Sacred Systems Pty Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform — including but not limited to loss of revenue, data, or business opportunity.
Our total liability to you for any claim arising from use of the Platform shall not exceed the total amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.
9. Privacy
Your use of the Platform is also subject to our Privacy Policy. We handle your data in accordance with the Australian Privacy Act 1988. We do not sell your personal information to third parties.
10. Modifications to the Platform or Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where changes are material, notify you by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
We may also modify, suspend, or discontinue features of the Platform at any time. We will provide reasonable notice for material changes that affect paid subscribers.
11. Termination
We may suspend or terminate your access to the Platform if you breach these Terms, with or without notice. You may terminate your account at any time by contacting us at hello@ndis-ready.com.au.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
